1. Media Release
Grant of Rights: By participating in the Exposure Series event (the “Event”), the participant hereby grants Work Beats Talent, LLC (“WBT”) the irrevocable, worldwide, and perpetual right to use, reproduce, display, distribute, and create derivative works from any photographs, videos, or audio recordings (collectively, “Media Content”) taken of the participant during the Event, including but not limited to for purposes of promotion, advertising, marketing, or education, across any and all media platforms, including social media, websites, and printed materials, without further compensation or approval.
Ownership and Access: The participant retains ownership of the Media Content they purchase from WBT, including video footage and performance data. However, WBT retains the right to use and store copies of such Media Content for its own promotional, educational, and internal purposes, and such content may be accessed or shared with the participant as per the terms of the service or purchase.
Waiver of Royalties: The participant acknowledges and agrees that they waive any right to royalties, fees, or compensation arising from the use of the Media Content for promotional or other lawful purposes as outlined above.
2. Trackman Data Collection Policy
Consent and Acknowledgment: By participating in the Event, the participant consents to the collection of their performance data, including but not limited to ball flight data, pitch velocity, spin rate, and other related metrics, using Trackman technology. The participant acknowledges that this data will be collected, analyzed, and retained by WBT for the purpose of enhancing the participant’s athletic development, as well as for any promotional or marketing efforts undertaken by WBT.
Privacy Assurance: WBT will not disclose or make publicly available any individual performance data without the express written consent of the participant. The participant acknowledges that WBT may retain copies of their data for internal use, including but not limited to event analysis, reports, and development tracking.
Compliance with Laws: The participant agrees to comply with all applicable laws, regulations, and terms of service related to the use of Trackman data, and further agrees that their use of Trackman data will not infringe upon any third party’s rights, nor violate any applicable laws, regulations, or agreements.
3. Content Ownership Agreement
Ownership of Event Media: All media content captured during the Event, including but not limited to video recordings, photographs, and audio, is the exclusive property of WBT. Participants acknowledge that, except for the purchased Media Content, WBT retains full rights to use, edit, and distribute the Event media in any manner deemed appropriate, including for promotional, marketing, or educational purposes.
4. Event Cancellation or Refund Policy
Refunds and Cancellations: In the event that the Event is canceled or rescheduled due to weather, unforeseen circumstances, or other factors beyond WBT’s control, participants will be eligible for a credit-based refund, to be applied toward future events or services offered by WBT.
Monetary Refunds: WBT reserves the sole discretion to issue a monetary refund under special circumstances, such as a participant’s inability to attend a rescheduled Event, provided such circumstances are communicated to WBT in a timely manner.
5. Property Damage Waiver
Liability for Property Damage: The participant agrees to be fully responsible for any damage caused to property, equipment, or facilities during the Event by their actions or negligence. The participant agrees to indemnify and hold harmless WBT from any and all claims, liabilities, costs, or expenses resulting from any such damages.
6. Spectator Liability Waiver
Waiver of Claims for Spectators: Spectators attending the Event do so at their own risk. Spectators hereby waive and release WBT, its officers, directors, employees, volunteers, agents, and affiliates from any and all liability for injuries, property damage, or loss that may occur while attending the Event.
7. Injury Waiver and Release of Liability
Assumption of Risk: The participant acknowledges that participation in the Event involves inherent risks, including but not limited to the risk of physical injury, illness, or property damage. By participating in the Event, the participant voluntarily assumes all risks associated with participation, including any medical conditions that may arise.
Release of Liability: To the fullest extent permitted by law, the participant agrees to release, discharge, and hold harmless WBT, its affiliates, employees, contractors, agents, and volunteers from any and all claims, demands, actions, or causes of action arising from participation in the Event, except for claims arising from gross negligence or willful misconduct on the part of WBT.
Medical Authorization: In the event of an emergency requiring medical attention, the participant authorizes WBT to secure medical treatment for the participant, at the participant’s expense, and agrees to assume responsibility for any costs associated with such treatment.
8. Insurance Acknowledgment
No Insurance Coverage: The participant acknowledges and understands that WBT does not provide any health, accident, or medical insurance coverage for participants in the Event. The participant is solely responsible for maintaining their own health and accident insurance during the Event, and agrees to provide such coverage at their own expense.
9. Acknowledgment and Agreement
Comprehensive Understanding: By participating in the Event, the participant acknowledges that they have read, understood, and agreed to all of the terms and conditions outlined in these Terms & Conditions. The participant confirms their voluntary and informed consent to the collection of media and performance data as described, as well as their understanding of their responsibilities and rights outlined herein.
Binding Effect: These Terms & Conditions are binding upon the participant and may not be modified except in writing by WBT. By proceeding with registration or participation in the Event, the participant agrees to abide by all terms and conditions set forth in this document.
